This Terms of Use Agreement ("Terms of Use") applies to use of the online shop  www.shop.mallorca-kinderbuch.com  website located at http:// www.shop.mallorca-kinderbuch.com. The Site is the property of Mallorca Kinderbuch S.L..(CIF: B-57552929) and registered in the commercial register of Palma de Mallorca/Spain.

1.     Activity
www.shop.mallorca-kinderbuch.com dedicates himself with the selling of books in the internet, by part-time employers, by business gifts or by market stands. All realized sales are subject to the spanish law.

2.     Content and available information on the website

www.shop.mallorca-kinderbuch.com has been created with highest possible diligence and accurateness within our possibilities. Yet, absolute correctness and completeness of content cannot be granted (f.e. typos).

In the case that an error occurred  without better knowledge, we will proceed to immediately correct the mistake.

www.shop.mallorca-kinderbuch.com reserves the right to change the offer presented on our website, as regards products, special offers, prices, conditions, service.

Contents, which are marked with a name only express the opinion of the corresponding author, and must not coincide with the opinion of Mallorca Kinderbuch S.L. That is also the case for public accessible places of the site, like as forum, guestbook, shop.  

3.     Applied tax rate

All prices quoted on www.shop.mallorca-kinderbuch.com are pre-tax, including the actual spanish V.A.T. of 4% of books and the corresponding shipping fee.  

4.     Purchase options

The client can choose between different ways of ordering and purchasing:

5.     Prices - Terms of Payment

All prices quoted on our site and in our shop include taxes  and shipping costs.

You can pay:

-    On account

-        by PayPal

-        Bank transfer

-        www.directebanking.com

After finishing the purchasing process the client will receive a confirmation email with his order information. Yet, the contract is not official, in the moment the clients offer has been sent to us. The client has 2 days as a gesture of goodwill to check on his/her order information for the last time and give us feedback. In the case an error occurs, by calling us or send an email to customer@mallorca-kinderbuch.com, we will proceed to immediate verification. Reclamation after these respective two days cannot be handled due to technical reasons. After finalizing these 2 days, the contract is officially valid and binding for both sides.

If the client chooses the payment option “paying on account”, the sum must be placed to our credit within 14 days after receiving the product (max. 1 month from the date of ordering). Clients that have posted a reclamation are excluded from that stated period. After receiving the duplicate, the sum has to be placed to our credit within 14 days. If you choose this payment option, post address for payment, bill and shipping must be identical. Paying on account only can be chosen for real products.

We do not accept orders realized by children under age – in that case the purchase has to be firmed or realized by an adult.

In case of delay or default of payment we reserve the right to reclaim default interest of 5% on the rate of interest published by the European central financial institute.

Until full payment the product remains property of the Mallorca Kinderbuch S.L.. In case of defaulted payment, we claim the right to reclaim already shipped products.

6.     Delivery 

The shipping is realized by post from Berlin, Germany, where the products are produced. We calculate 2 weeks for shipping  from the moment of ordering, although that is not an exact date and real shipping duration depends on the final destiny of shipping, too. For further details about the individual status and evaluated shipping time of the respective order, the client can contact us at every moment.

We reserve the right to adapt our shipping prices to the actual prices of the company responsible for shipping.

All the prices mentioned in the product descriptions are including the shipping fees worldwide. If the books are not available in the moment of ordering, you are not able to put them into the shopping cart.

7.     Withdrawal and devolution

Our personal books are custom-made design, which means that the books are produced individually to the information the client wishes. Due to this, they are excluded of the usual right of devolution. Mallorca Kinderbuch S.L. only is liable for defects (loose or missing pages, etc.) or typos regarding the introduced personal information as chosen by the clients. The client has two days of good will to check on the correctness of the dates introduced during the ordering process and ask us to verify them respectively.

After receiving the product, the client has 2 weeks to reclaim for any defect – in the case the defect results to be a typo, we will check on the order confirmation. If the transferred dates of the order coincide with the appearing dates in the book, which means that the error already existed in the moment of ordering and the client did not correct the error within the 2 days, Mallorca Kinderbuch S.L. is not responsible for the defect. Of course, if the dates were correct and the typo was our fault, we will take responsibility. If the client wants to return the book to us for checking the reclaimed error or damage, he has to do so paying shipping himself/herself. In case that the defect is under our liability, we will then  repay the corresponding amount of shipping to his/her account. Yet, the client, when ordering, confirms that he checked the correctness of his dates!

Products, that do not contain any personal information (p.e. products of merchandise) are subject to the usual withdrawal and devolution rights. Reclamation has to be placed without obligation to give any reasons within 14 days. Withdrawal can be realized in any moment, as long as the product has not been passed on the transport company.

In case that devolution is not caused by an obvious defect, the client pays shipping return.

The client can reclaim by writing to the downstanding address, by mail customer@mallorca-kinderbuch.com, or by calling +34 971 72 90 71 - or returning the book sending it directly to downstanding address. The compliance of the time for reclamation is checked by date stamp or the date the mail received us.

In the case the client received a product which wasn’t ordered by him, he has the right to send it back free of charge and delivering of the right product, which will not be charged to the client either.

In the case that Mallorca Kinderbuch S.L. is responsible for any reclaimed defect, we will send him/her a duplicate of the reclaimed product free of charge or pay the amount already deposited by the client, back into his/her account.

Books, that have slight typo defects (f.e. wrong names) can be bought greatly reduced in our online-shop. As those books are already printed, the client cannot enter any individual date by purchasing them. Their purchase is subject to usual withdrawal and devolution terms, with 14 days time for reclamation without the need of giving any reasons.

8.     Client’s responsibilities

The client is obliged to provide us with personal information during registry or purchasing and to introduce them correctly and truly, and keep them actual. He is obliged to check the introduced individual information for the books upon correctness and completeness – in case of ordering by letter or fax to check furthermore upon legibility.

Buying online, the client will be asked explicitly to check upon his information before finishing the purchase transaction. By ordering, the client accepts the General terms and conditions of trade.

If the client uses this site, he/she is responsible for maintaining the confidentiality of his/her account and password and for restricting access to his computer. Furthermore, he/she agrees to accept responsibility for all activities that occur under his/her account or password. 

9.     Security and confidentiality

We are preoccupied with our clients’ security and do our best to provide them with the highest level of security and confidentiality for their information, to grant a secure transaction or communication between Mallorca Kinderbuch S.L. and the client. All online-operations are realized over a secure Server based on SSL, that protects the dates of hostile attacks. The information of the purchasing procedure are guarded in a special database.

We grant the security and confidential use of the client’s personal information, account details and other provided information in accordance with the (Spanish) law 15/1999, 13th of December, for the protection of personal information.

In accordance with that law, the client of www.shop.mallorca-kinderbuch.com has the right to inform himself/herself about the information provided, correct or delete them, by writing to Mallorca Kinderbuch S.L., Aptd. Correos 874, 07080 Palma de Mallorca, Spain.

We inform you, that details of any purchase transaction stay excluded from that right, needed to be stored for 5 years according to Spanish law and due to that cannot be deleted, even after a written request. 

10.  Data protection – Personal dates and their use 

1.     Client’s reviews

If the client decides to publish a product review, he/she grants Mallorca Kinderbuch S.L. a non-exclusive, royalty-free, perpetual, irrevocable and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create, derivative works from, distribute, and display such content throughout the world in any media.

If the author prefers not to stay anonymously, we always try to name the author of the preview. At the same time, we claim the right, to eventually change its structure (by f.e. only show parts of the preview

We also claim the right to show previews only for a certain period of time, review them and to remove or edit parts, or in extreme cases, delete them, f.e. in case of law infringement (political campaigning, commercial solicitation, chain letters, spam). The client may not use a false email-address, impersonate any person or entity.

The previews are written by the client, and therefore reflects his opinion. That opinion must not tally with the opinion of Mallorca Kinderbuch S.L., so we do not take responsibility and assume no liability for any content posted by the client or any third party.

2.     Personal information

Personal information has to be provided and is primarily used for processing your order, payment and shipping. All data you give to Mallorca Kinderbuch S.L. or one of its employers, will be stored in a special archive for personal dates and are on our responsibility.

The company, responsible for shipping, will obtain the personal information relevant for shipping.

3.     Anonymous dates and statistic use

By visiting our website, there will be collected data, like f.e. visited product detail sites, or from which country you are. This information is anonymous and will only be used for statistical reasons to improve and provide our service, based on your needs. Your data will NEVER be sold or passed on to another party, for private or commercial use!

11.  Place of jurisdiction

Place of jurisdiction shall be the location of our registered office. We reserve the right to

enter claims at the court having statutory jurisdiction over Supplier.

Unless stated otherwise in the order, the place of performance shall be the place stated

in the order and, alternatively, the location of our registered office.
